Assignment:

On May 15, 2001, your faxed instructions were received to meet with the above client, have her complete the necessary paperwork to open a personal injury file for your office, and begin a preliminary investigation into her case.

Activity:

A meeting was scheduled with Ms. XXXXXXX for the evening of May 15, 2001. Your sign-up kit was completed and faxed to your office that evening. The original is attached with this report. Please note, that all the medical records she was given at the emergency room are attached with the P.O.A. Photographs were taken of Ms. XXXXXXX's face and arm and are included with the attachments. The original of the sign-up kit and P.O.A. were mailed to your office on May 16, 2001.

On May 16th, a trip was made to the accident scene and photographs were taken of the intersection. A diagram was made of the intersection and is attached. There are two retail establishments at this intersection which were open at the time of the accident. Sidney XXXXXX is the manager of the Chevron station at the southwest corner and was an eye witness to the accident. He did not speak to the HPD officer who was handling the accident, because he was on duty and could not leave his post. He did however, get word to the officer that he saw the accident. As of this date, the officer has not asked him for his statement. A statement was taken from Mr. XXXXXXX and is attached. Mr. XXXXXX is extremely interested in helping our client and will be willing to do whatever is necessary to assist us with our claim.

The convenience store at the northeast corner of the intersection was open at the time of the accident. The clerk on duty, Barbara, did not see the accident happen. She did hear the accident and went outside with the only customer in her store to see what had happened. A statement was taken from her on May 28th by telephone. It could not be arranged to meet with her in person. A transcription of that statement is attached. The customer who was in her store at the time of the accident happened to be a regular customer. With Barbara XXXXXX's assistance, a meeting was arranged with Ray XXXXX and a statement was taken from him on May 27, 2001. Mr. XXXXX's statement is attached to this report. Please note, that Mr. XXXXX is an interstate truck driver and is very difficult to reach. Any future contact with Mr. XXXXXX should be through his voice mail number which is included in his statement.

As you know, our client's vehicle was at a city facility. I had kept a copy of the P.O.A. in case it was needed to photograph her vehicle. On May, 17, 2001, the P.O.A. was used to gain access to her vehicle and photographs were taken. These photographs are included with the other attachments to this report.

The accident report was not released until May 21st. It was picked up from HPD and a copy was faxed to your office that same day. The original is attached. A copy of the report was mailed to our client for her review. I instructed her to call me after she had received the report and she did so. She did not find any discrepancies on the report. She agreed with the HPD officer's account of the accident. There were two additional witnesses listed on HPD's report. Both of these witnesses were contacted and a statement was taken from Terrance XXXXXX. Mr. XXXXXX was very cooperative and gave his statement willingly. The original is attached and a copy has been maintained for my file. The other witness listed on the accident report, Harvey XXXXXX, was not cooperative. As of this date, he has not agreed to give his statement. He is concerned that he will get called to court and he was driving with an expired license at the time of the accident. It is very possible that after the traffic court matter has been resolved, I will be able to get a statement from him. I will calendar this for July 1, 2001 and follow up after we see if the defendant driver protests the citation he was given by HPD.

After obtaining a copy of the accident report, the location of the defendant's vehicle was determined. A trip was made to Rick's Body Shop on West Gray and photographs were taken of the vehicle on May 22, 2001. The photographs are attached. Please note, that his state inspection sticker was expired at the time of the accident.

Since this concludes current instructions, I will be closing my file at this time. If further assistance is needed, please feel free to contact me. I will let you know about my follow up with witness, Harvey XXXXX.
